Measures for the Administration of Culture and Tourism Voluntary Services in Guangzhou
Chapter 1 General Provisions
Article 1 For the purposes of regulating culture and tourism voluntary service activities, promoting the integrated development of culture and tourism voluntary services and giving full play to the role of culture and tourism voluntary services in the construction of culture and tourism public service system, these Measures are hereby formulated in accordance with the Law of the People's Republic of China on the Protection of Public Cultural Services, the Regulation on Voluntary Services and the Regulation of Guangdong Province on Voluntary Services and on the basis of the actual conditions of this city.
Article 2 These Measures shall apply to the culture and tourism voluntary services provided within the administrative area of this city and the activities relevant to voluntary services.
Article 3 The term “culture and tourism voluntary services” herein refers to the public welfare services provided by culture and tourism voluntary service organizations and volunteers voluntarily free of charge to improve the culture and tourism public service system, facilitate the public to enjoy public culture and tourism life and promote social civilization and progress.
The term “culture and tourism volunteers” herein refers to the individuals providing public welfare culture and tourism services voluntarily free of charge to the society or others with their own time, skills, resources, etc.
The term “culture and tourism voluntary service organizations” herein refers to:
(1) Non-profit organizations legally established to provide culture and tourism voluntary services;
(2) Culture and tourism volunteer service teams formed by state organs, enterprises/institutions, people's organizations or social organizations or spontaneously organized by the public.
Article 4 Culture and tourism voluntary services shall be based on free will, free of charge, equality, integrity and legitimacy and shall not violate the social morality, damage the social and public interests or the lawful rights and interests of others or endanger the national security.
Chapter 2 Organization and Management
Article 5 The culture and tourism voluntary services in Guangzhou shall be under the overall guidance of the municipal spiritual civilization construction guidance authority, the administrative management of the municipal civil affairs authority and the business management of the municipal culture and tourism service authority.
Article 6 The municipal culture and tourism service authority shall incorporate the culture and tourism voluntary service work into its own culture and tourism business development plan, reasonably arrange the funds required for voluntary services and make the overall planning, coordination guidance and supervisory inspection of the city's culture and tourism voluntary services.
All district culture and tourism service authorities shall be responsible for promoting the culture and tourism voluntary service work within their respective administrative areas, establishing coordination mechanisms for culture and tourism voluntary service work and strengthening the standardized management, supervisory inspection and experience promotion of the culture and tourism voluntary services.
Article 7 In order to promote the development of culture and tourism voluntary services, the municipal culture and tourism service authority shall form the Guangzhou Culture and Tourism Volunteer Corps (hereinafter referred to as the Municipal Corps). Its chief shall be the deputy director in charge, its deputy chief shall be the person in charge of the relevant business office and the municipal cultural center, and the members of its leading body shall be the leaders in charge of the units under the bureau and the person in charge of the tourism industry associations.
All government agencies directly under the municipal culture and tourism service authority, all districts and the tourism industry shall set up culture and tourism volunteer divisions respectively. The volunteer divisions of the municipal government agencies shall be under the direct leadership of such municipal government agencies, the volunteer division of each district shall be under the direct leadership of the culture and tourism service authority in the same district, and the volunteer division of the tourism industry shall be under the business guidance of the municipal tourism industry association and be integrated into the Municipal Corps for unified guidance. Each volunteer division may set up a volunteer service team as needed for its work. The volunteer service team shall accept appropriate guidance from the volunteer division and fulfill the culture and tourism voluntary service tasks assigned by the volunteer division.
The office of the Municipal Corps in Guangzhou Cultural Center shall participate in the overall planning, coordination and guidance of the city's culture and tourism voluntary services, and be responsible for the management of the information platform for culture and tourism voluntary services in Guangzhou, the construction and management of the training base for culture and tourism volunteers, as well as the routine work, such as statistics and data submission.
Each culture and tourism volunteer division shall accept the guidance of the Municipal Corps, be responsible for the recruitment, training, management and coordination of culture and tourism volunteers within its administrative area (government agency), and carry out culture and tourism voluntary service activities in a planned and organized way, so as to provide a platform for culture and tourism volunteers to give full play to their talents.
Municipal, district and town (sub-district) public cultural facilities and tourism institutions shall actively form culture and tourism volunteer service teams, conduct unified guidance and management according to the requirements of the culture and tourism service authorities at the same level, establish unified names, implement hierarchical formation and classified management and truthfully submit relevant information.
Article 8 The Municipal Corps shall establish a joint meeting system, and the members shall be the heads of various culture and tourism volunteer divisions. The Municipal Corps shall organize and hold joint meetings in due time to study, deploy and coordinate relevant matters.
Article 9 Culture and tourism voluntary service organizations shall encourage and guide Communist Party members to take the lead in participating in culture and tourism voluntary service activities, strictly abide by relevant policies and regulations and strengthen the leading role of socialist core values.
Chapter 3 Culture and Tourism Volunteers
Article 10 Culture and tourism volunteers fall into three categories: expert culture and tourism volunteers, professional culture and tourism volunteers and general culture and tourism volunteers.
Expert culture and tourism volunteers refer to those who have made certain achievements in the national, provincial or Guangzhou culture and tourism voluntary services, art, tourism, literature, history and other professional (industrial) fields, and have great influence and high popularity, such as socially well-known artists, inheritors of intangible cultural heritage recognized at or above the provincial level, and professionals with deputy senior titles or above.
Professional culture and tourism volunteers refer to those with relevant professional knowledge and skills or vocational certificates in the culture and tourism industry, such as music, dance, drama, folk art, fine arts, calligraphy, photography, tour guide, tourism planning, tourism management, architecture, design and popular science.
General culture and tourism volunteers refer to those who provide services that do not require professional knowledge, skills or vocational certificates, such as route guidance, consultation, civilized publicity, order maintenance and caring for the people.
Article 11 Culture and tourism volunteers may register their basic personal information, such as identity, service skills, service time and contact information, through the voluntary service information systems recognized by the civil affairs authorities.
The basic personal information provided by culture and tourism volunteers shall be authentic, accurate and complete.
Article 12 Culture and tourism volunteers shall enjoy the following rights:
(1) Voluntarily join or quit the culture and tourism voluntary service organizations;
(2) Independently decide whether to participate in culture and tourism voluntary service activities;
(3) Obtain authentic, accurate and complete information about the culture and tourism voluntary services involved;
(4) Obtain the necessary working conditions and security measures for participating in culture and tourism voluntary services;
(5) Obtain the training required for participating in culture and tourism voluntary service activities;
(6) Require the culture and tourism voluntary service organizations to solve the difficulties encountered in participating in voluntary service activities;
(7) Require the culture and tourism voluntary service organizations to truthfully issue relevant voluntary service certificates free of charge;
(8) Put forward opinions and suggestions on the culture and tourism voluntary service activities involved;
(9) Other rights stipulated by laws, regulations and the articles of association of the voluntary service organizations, as well as those agreed in the voluntary service agreements.
Article 13 Culture and tourism volunteers shall perform the following obligations:
(1) Volunteers who accept the arrangements of culture and tourism voluntary service organizations to participate in voluntary service activities shall obey the management and receive necessary training;
(2) Volunteers who are supposed to provide culture and tourism voluntary services as agreed but are unable to perform these services for some reason shall promptly inform the voluntary service organizations or voluntary service demanders;
(3) Volunteers shall not ask for remuneration directly or in disguised form from organizations or individuals that accept culture and tourism voluntary services;
(4) Volunteers shall not take advantage of their status as culture and tourism volunteers to engage in any activities for profit or against social morality;
(5) Volunteers shall respect the personal dignity of the voluntary service objects and shall not infringe upon their legitimate rights and interests;
(6) Volunteers shall maintain the image and reputation of culture and tourism voluntary service organizations and voluntary services;
(7) Other obligations stipulated by laws, regulations and the articles of association of the voluntary service organizations, as well as those agreed in the voluntary service agreements.
Chapter 4 Culture and Tourism Voluntary Service Organizations
Article 14 Culture and tourism voluntary service organizations shall perform the following duties:
(1) Develop culture and tourism voluntary service plans;
(2) Raise, manage and use funds and materials for culture and tourism voluntary services according to law;
(3) Organize culture and tourism voluntary service activities and related training;
(4) Be responsible for the recruitment, registration, training, service record and incentive security of culture and tourism volunteers, and truthfully record their relevant information, such as basic personal information, voluntary service, training, recognition rewards and evaluation.
(5) Provide necessary working conditions and basic security for culture and tourism volunteers, and help them solve practical difficulties encountered in participating in voluntary service activities;
(6) Issue relevant voluntary service certificates according to the requirements of culture and tourism volunteers and relevant management regulations;
(7) Carry out culture and tourism voluntary service publicity, exchanges and cooperation;
(8) Perform other duties prescribed by laws, regulations and rules.
Article 15 Culture and tourism voluntary service organizations shall make clear the recruitment standards for volunteers, verify the basic information of volunteers, establish work files for volunteers by category based on their professional skills, job responsibilities, service contents and other conditions, and reasonably arrange their posts.
Article 16 Culture and tourism voluntary service organizations shall, before volunteers provide voluntary services, train them in the knowledge and skills required for voluntary services, including general training, on-the-job training and professional training.
Culture and tourism voluntary service organizations shall be encouraged to establish training bases for culture and tourism volunteers by means of various cultural centers, libraries, museums, art galleries and other public cultural facilities at all levels, as well as tourist scenic spots (attractions), tourism enterprises and tourism colleges and universities. Training at different levels and categories shall be carried out for the culture and tourism volunteers in the city according to their conditions such as professional skills, job responsibilities and service content.
Article 17 Culture and tourism voluntary service organizations shall explain to volunteers the risks that may occur during the process of providing voluntary services, such as personal safety risks and physical and mental health risks.
Article 18 Culture and tourism voluntary service organizations shall, as needed for voluntary service activities, provide volunteers with such necessary hardware as places, equipment and materials, as well as such subsidies as insurance, transportation, accommodation and communication.
Article 19 Culture and tourism voluntary service organizations shall regularly carry out comprehensive evaluation of culture and tourism volunteers in terms of service attitude, service time, service content, service effect and service satisfaction, which shall be the basis for assessment and recognition of volunteers. Culture and tourism voluntary service organizations may comprehensively evaluate volunteers through the combination of manager evaluation, volunteer evaluation, self-evaluation and service object evaluation, and combine daily assessment with regular assessment.
Article 20 Culture and tourism volunteers may voluntarily withdraw from culture and tourism voluntary service organizations. Those who voluntarily withdraw shall go through the cancellation procedures in accordance with the relevant provisions of the registered voluntary service information system. Those who fail to go through the cancellation procedures in the information system may, upon written application, go through the procedures with the local culture and tourism voluntary service organization.
For volunteers who fail to comply with relevant regulations or fulfill the obligations stipulated in Article 13 hereof and have caused adverse effects, the culture and tourism voluntary service organizations may establish a withdrawal mechanism to cancel their volunteer qualifications.
Article 21 Culture and tourism industry associations and chambers of commerce shall be encouraged to work together to promote cooperation and exchanges in the culture and tourism voluntary service industry and promote the integrated development of culture and tourism voluntary services.
Culture and tourism industry organizations shall be encouraged to participate in the formulation and implementation of relevant laws and regulations, promotion policies and industry development plans.
Culture and tourism industry organizations shall perform the following duties:
(1) Jointly establish and improve industry norms and standards, promote industry self-discipline, and stimulate standardized and formal development;
(2) Guide members to carry out culture and tourism voluntary service activities in accordance with the law, and organize corresponding training, exchanges and cooperation;
(3) Carry out statistics, development research and experience discussion on culture and tourism voluntary services, and promote the frontier development of culture and tourism voluntary services;
(4) Reflect the demands of the industry, safeguard the legitimate rights and interests of members, and carry out supervision and advanced recognition of volunteers who provide voluntary services in the industry;
(5) Other duties stipulated by laws, regulations and the articles of association of the industry organization.
Chapter 5 Culture and Tourism Voluntary Service Activities
Article 22 The places used for culture and tourism voluntary services shall include new era civilization practice centers (institutes, stations), public libraries, cultural centers (stations), museums, art galleries, archives centers, martyr cemeteries, memorial halls, urban cultural themed blocks, historical and cultural trails, city parks, forest parks, amusement parks, zoos, botanical gardens, aquariums, marine museums, ancient villages and towns, and nature reserves open to tourists, volunteer stations, Guangzhou's tourist information rescue service centers and tourist distribution centers.
Culture and tourism voluntary service organizations and volunteers may provide the following services in the above-mentioned areas:
(1) Provide guidance on civilized activities such as the maintenance of public order and public service facilities, and provide care for special groups, such as the elderly, the infirm, the sick, the disabled and the pregnant;
(2) Participate in public welfare services such as publicity of culture and tourism services, artistic performances, coaching and training, display and demonstration, reading promotion, and popularization of digital skills;
(3) Provide guidance on and popularization of public welfare exhibitions, history, geography, culture, flora and fauna, local customs, economic and social development, etc.;
(4) Participate in such work as the management of grass-roots cultural facilities and the organization of mass cultural activities;
(5) Participate in such work as the publicity and display of national folk culture and the protection of cultural heritage;
(6) Assist the relevant functional departments of the government in supervising and giving feedback on culture and tourism markets;
(7) Participate in the provision of public welfare culture and tourism services through digital platforms;
(8) Participate in the exchange of culture and tourism voluntary services at home and abroad;
(9) Carry out theoretical research on culture and tourism voluntary services;
(10) Participate in the service of various emergency public affairs initiated by the culture and tourism service authorities;
(11) Other public welfare culture and tourism services.
Article 23 Culture and tourism voluntary service organizations and volunteers shall uniformly wear volunteer uniforms or uniform logos when carrying out voluntary service activities, and use Chinese voluntary service logos and culture and tourism volunteer emblems.
Article 24 Culture and tourism voluntary service organizations and volunteers may, as appropriate, sign written or electronic agreements, specifying the rights and obligations of the parties, and agreeing on the content, method and duration of the voluntary services.
A voluntary service agreement shall include the following main contents:
(1) Basic information of each party;
(2) Rights and obligations of each party;
(3) The content, method, time and place of the voluntary services;
(4) Working conditions, training, safety precautions and risk prevention measures;
(5) The modification, rescission and termination of the voluntary service agreement;
(6) Resolution of disputes related to voluntary services;
(7) Other matters that need to be clarified.
For specific contents of the agreement, please refer to the sample text of voluntary service agreement formulated by the civil affairs department.
Article 25 Culture and tourism voluntary service organizations and volunteers shall not disclose or divulge state secrets, business secrets, personal privacy and other legally protected information acquired in the course of providing culture and tourism voluntary services, and shall not make use of the relevant information for commercial transactions or profit-making activities.
Article 26 Culture and tourism voluntary service organizations shall establish and improve the protection system and implementation mechanism for the rights and interests of volunteers, and standardize the maintenance and protection of the legitimate rights and interests of volunteers.
Culture and tourism voluntary service organizations shall, according to the actual needs, purchase appropriate personal accident insurance for volunteers.
Article 27 Culture and tourism voluntary service organizations shall truthfully record the service, training, recognition rewards, evaluation and other information of volunteers, enter them into the voluntary service information system recognized by the civil affairs department in accordance with the unified information data standards, and issue voluntary service certificates for volunteers in a timely, free and truthful way according to their needs.
The hour records and service certificates shall be the responsibility of the culture and tourism voluntary service organizations.
The municipal culture and tourism service authority shall strengthen the supervision and examination of the hours records and service certificates of culture and tourism voluntary services.
Article 28 Culture and tourism voluntary service organizations shall, as needed for their work and responsibilities, be encouraged to establish culture and tourism voluntary service sites by relying on public cultural facilities and places such as new era civilization practice centers (institutes, stations), public libraries, cultural centers (stations), museums, art galleries, as well as tourist concentration areas such as commercial blocks, transportation hubs, scenic spots, and volunteer stations around tourist attractions. The municipal culture and tourism service authority shall establish unified standards for the construction of service sites throughout the city.
Chapter 6 Promotion Measures
Article 29 The funds for culture and tourism voluntary service activities shall come from:
(1) Government support;
(2) Legally obtained social donations and subsidies;
(3) Other lawfully-earned income.
Article 30 Culture and tourism service authorities at all levels and culture and tourism voluntary service organizations shall, as needed for their actual work, arrange funds for culture and tourism voluntary services.
Culture and tourism service authorities at all levels and public culture and tourism voluntary service organizations shall provide reasonable and necessary financial support for culture and tourism voluntary services, which shall be included into the financial budget arrangements of their own or at the corresponding levels.
Article 31 Culture and tourism service authorities at all levels shall provide necessary support for culture and tourism voluntary services, and establish mechanisms for management evaluation, incubation cultivation and incentive security.
Government departments shall be encouraged to support the development of culture and tourism voluntary services through such means as service purchases and venture capital activities.
Article 32 Natural persons, legal persons and other organizations shall be encouraged and supported to donate and fund culture and tourism voluntary service activities. Donated and funded property shall be used for public welfare activities, respecting the wishes of donors and funders.
The establishment of development funds for culture and tourism voluntary services in accordance with the law shall be encouraged, so that these funds can be used to finance and support culture and tourism voluntary service activities in such aspects as project development, site construction, skills training, incentive feedback to volunteers, and rights and interests protection.
Article 33 The raising, use and management of funds for culture and tourism voluntary service activities shall comply with the provisions of laws and regulations, and shall be open and transparent. These funds shall be earmarked for special purposes. No organization or individual may misappropriate, privately divide or embezzle these funds.
The funds for culture and tourism voluntary services shall be used primarily for:
(1) Direct service activities: the organization, implementation, publicity and promotion of culture and tourism voluntary service activities;
(2) Service supported activities: culture and tourism voluntary service research, volunteer training, identification record, incentive recognition, rights and interests protection, material security, insurance purchase for volunteers, etc.;
(3) Other expenses related to culture and tourism voluntary services: venue rental, item making, etc.
Culture and tourism voluntary service organizations shall report to the competent business departments every year on the use and management of the properties supported by the government and donated by the society, make these information public, and accept the supervision of relevant departments, donors, volunteers and the society according to law.
Article 34 State organs, public institutions, enterprises, people's organizations and social organizations shall, by giving full play to their professional advantages, be encouraged to form culture and tourism volunteer service teams to participate in culture and tourism voluntary services.
Culture and tourism service authorities at all levels shall establish the “culture and tourism volunteer talent pool” and encourage culture and tourism experts and scholars, social celebrities, senior practitioners, and grass-roots literature and art backbones to participate in voluntary services, so as to enhance the professional level of culture and tourism voluntary services.
Article 35 Culture and tourism voluntary services shall be provided in schools and communities. The bases for extracurricular activities and social practice of teenagers shall be set up in culture and tourism service sites. The training courses in culture and tourism voluntary services and other related activities shall be arranged according to the characteristics of teenagers.
Article 36 The city's culture and tourism voluntary service organizations shall be encouraged to innovate the contents, projects, working methods and activity carriers of culture and tourism voluntary services by relying on their own characteristics and advantages, so as to explore culture and tourism voluntary service models with local and industrial characteristics, and promote the formation of distinctive voluntary service brands.
The municipal culture and tourism service authority shall establish a system for the selection of demonstration sites for culture and tourism voluntary services, and encourage qualified culture and tourism voluntary service organizations to participate in the corresponding creation and declaration work.
Article 37 The municipal culture and tourism service authority shall be responsible for the overall release, and give preferential treatment to volunteers above the star level and outstanding volunteers of the year in such aspects as art observation and training, cultural and artistic consumption, public welfare cultural services, and tickets for attractions and scenic spots.
The city's culture and tourism voluntary service organizations shall, according to their own actual conditions, be encouraged to establish incentive systems and points exchange systems for culture and tourism volunteers, and give full play to their own advantages to provide personalized incentive measures for outstanding volunteers.
Article 38 The municipal culture and tourism service authority shall regularly commend and reward culture and tourism volunteers in accordance with the national and provincial regulations on commendation and reward.
Culture and tourism voluntary service organizations shall be encouraged to commend and reward volunteers, voluntary service workers, volunteer service teams and voluntary service projects that have made outstanding performances in culture and tourism voluntary service activities and have great social influence, as well as units and individuals that support the culture and tourism voluntary service cause, and shall recommend them to participate in other selection activities.
Article 39 Culture and tourism voluntary service organizations shall be encouraged to feature publicity columns for culture and tourism volunteers on their official websites, so that such carrier platforms as news media and new media can be used to increase the publicity of culture and tourism voluntary services.
Article 40 Culture and tourism voluntary service organizations shall be encouraged to explore the image value of culture and tourism volunteers, develop cultural and creative products with independent intellectual property rights and distinctive local characteristics, such as culture and tourism voluntary service crafts and souvenirs, and use the proceeds to promote the development of culture and tourism voluntary services.
Article 41 Culture and tourism voluntary service organizations and volunteers shall be encouraged to meticulously plan culture and tourism voluntary service projects close to the people by relying on the new era civilization practice center and centering on promoting the study and practice of scientific theories, publicizing and expounding the Party's policies, cultivating and practicing mainstream values, enriching and activating cultural life, and continuously changing customs, so as to promote the development of the new era civilization practice center into a broad stage for providing culture and tourism voluntary services with Guangzhou characteristics.
Article 42 Culture and tourism volunteers shall be encouraged to go deep into public cultural positions in rural areas, children's palaces in rural schools, and rural tourist destinations to advocate a scientific, civilized and healthy way of life, promote rural civilization, create a rural cultural atmosphere, and improve the quality of rural tourism by carrying out culture and tourism activities that people are willing to participate in and are easy to participate in.
Article 43 The culture and tourism voluntary services in Guangzhou and the Guangdong-Hong Kong-Macao Greater Bay Area shall be promoted for coordinated development. Practical cooperation shall be carried out in such areas as personnel training, professional training, project research and development, subject research, selection and establishment of the advanced typical, and publicity and promotion, so as to achieve resource sharing and deepen cooperation and exchanges.
Chapter 7 Supplementary Provisions
Article 44 Guangzhou Municipal Culture, Radio, Television and Tourism Bureau shall be responsible for the interpretation of these Measures.
Article 45 These Measures shall come into force on the date of issuance and shall be valid for five years.
