Measures of Guangzhou Municipality for the Administration of Special Funds for the Development of Cultural and Tourist Industries
Chapter 1 General Provisions
Article 1These measures are formulated according to the provisions of the Opinions of the General Office of Guangzhou Municipal People's Government on Accelerating the Innovation and Development of Cultural Industry (SFBG[2018]28) and other documents, and with a view to turning Guangzhou into a model city of a socialist cultural power, boosting the comprehensive strength of urban culture and giving Guangzhou a new look.
Article 2The "special funds for the development of cultural and tourist industries in Guangzhou" (hereinafter referred to as "special funds") refers to the funds specially allocated by the municipal public finance to promote the development of cultural and tourist industries in Guangzhou. The scale of such special funds is 300 million CNY per year. The projects supported by such special funds shall have good cultural and tourist attributes and market prospects, and can bring good social and economic benefits into play.
Article 3Act on the basis of openness and justice, selecting the best and supporting the strong, performance orientation, and combining rewards with subsidies, so as to give full play to the guiding and incentive role of public funds.
Article 4Relevant municipal and district government sectors shall act in the administration and supervision of special funds ex officio.
The municipal bureau of culture, radio, television and tourism is responsible for preparing the annual budget, and the guideline for annual application for funds according to the reward and support standards and scope, organizing the application review, undertaking information disclosure and performance management, and tracking and supervising the implementation of the budget for such special funds.
The municipal finance bureau is responsible for auditing, submitting for approval and issuing the budget for special funds in accordance with the regulations regarding budget administration, organizing the implementation of financial supervision and inspection and overall performance evaluation of the special funds, and supervising the information disclosure on the administrative platform.
Relevant district government sectors are responsible for the collection and preliminary examination of relevant application materials for relevant projects ex officio.
Article 5The municipal authority in charge of movie industry is responsible for formulating the measures for administration of, and the guidelines for applying for, the funds for movie industry support projects, and organizing the implementation thereof separately; the municipal bureau of culture, radio, television and tourism is responsible for incorporating the movie industry support projects into the special funds for the purpose of preparing budgets, and does not participate in the specific application review and administration.
Chapter 2 Scope and Standard of Support and Reward
Article 6Guangzhou shall implement the digital strategy for cultural industry, build a national digital cultural industry cluster, allocate no less than 40 million CNY of support funds every year, and support no less than 100 projects and platforms with originality and market development potential in digital cultural industry, new formats of cultural and tourist industries, ultra-high definition video content creation and production, animation games and related industries, so as to encourage innovation, stimulate consumption and empower creative ideas.
Article 7For enterprises engaged in production and business activities in Guangzhou, new or expanded world-class theme parks and important scenic spots, they will be given financial support depending on their respective actual total investment in tourism or social contribution in Guangzhou. For projects with an actual investment amount of more than 1 billion CNY, support shall be given according to 1% - 3% of the actual investment amount (excluding land use fee) of that year, and the maximum amount of support for a single project shall not exceed 50 million CNY.
Article 8Guangzhou shall support the excellent traditional culture inheritance projects, and for the intangible cultural heritage studios and workstations newly recognized by Guangzhou, grant each studio (or workstation) 300,000 CNY annually. In principle, the subsidy period shall not exceed 3 years cumulatively. The national, provincial and municipal intangible cultural heritage representative projects will be supported, with a maximum of 300,000 CNY of support for each project.
Article 9Guangzhou shall support the cluster development of cultural and tourist industries, encourage the parks to optimize operation administration, to improve supporting services, to develop new business forms, and to enhance the scale and quality. For those national industrial parks (or concentration areas) that have been rated as national cultural industry demonstration parks, national cultural and financial cooperation demonstration zones, national cultural industry and tourist industry integration development demonstration zones, or China (Guangzhou) ultra-high definition video innovation industry demonstration zones, a reward of up to 5 million CNY will be given to each of them. For those rated as provincial/municipal cultural industry demonstration zones, cultural and tourist industry integration development demonstration zones and other provincial and municipal industrial parks (or concentration areas), a reward of up to 500,000 CNY or 300,000 CNY shall be given to each of them.
Article 10Guangzhou shall encourage consumption in cultural and tourist industries, support the establishment of a national cultural and tourism consumption demonstration city, and expand and improve the level of consumption in cultural and tourist industries. The incentive for the travel agencies that attract tourists to Guangzhou shall be subject to the Incentive Measures of Guangzhou Municipality for Organizing and Receiving Tourists to Guangzhou(SLFG[2018]2). Each year, no more than 10 million CNY will be allocated to organize professional and mass literary and art groups to perform for the benefit of the people, to express sympathy for the people, to send operas to the countryside, and to spend money on culture and tourism for the benefit of the people.
Article 11Investment onGuangzhou Cultural Industry Fair shall be encouraged, with no less than 10 million CNY of special funds every year. Priority support will be given to the sub-projects with actual transaction volume at the Guangzhou Cultural Industry Fair, and brand marketing support of no more than 2 million yuan will be given to a single project at the rate of 20% of the volume of actual investment in the project.
Article 12Guangzhou shall support the creation of high-quality TV dramas and documentaries, and give a total reward of up to 5 million CNY per year. Ultra-high definition (or high-definition) high-quality TV series, which have won the Flying Sky Award, the Golden Eagle Award or the Magnolia Award for Chinese TV series, will be given a maximum reward of 1 million CNY each. For the ultra-high definition (or high-definition) high-quality documentaries that have won the Scarlet Gold Cotton Award at China (Guangzhou) International Documentary Festival, a reward of up to 1 million CNY will be given to each of them.
Article 13A number of famous artists' studios shall be set up, no less than 3 each year, with a total support of up to 10 million yuan. In principle, the support period should not exceed 5 years. Talent cultivation programsin cultural and tourist industries shall be carried out, and appropriate funds shall be allocated for the discovery, cultivation and introduction of cultural and tourism talents.
Article 14Guangzhou shall support the creation of fine works of literature and art.
Guangzhou shall encourage the early creation of original plays, support the creation of 10 early scripts every year, and give each project 100,000 CNY as support.
Each year, no more than 10 creative plays will be selected, and each of them will be given early support of no more than 2 million CNY.
Guangzhou shall support the creation and arrangement of high-quality plays, select up to 5 high-quality plays every year, and gives each up to 5 million CNY as support.
Excellent digital music creation is encouraged, and up to 2 million yuan of support shall be allocated every year.
For the works that have won the "five best ones" award of the Central Publicity Department of the CPC Central Committee for spiritual civilization construction, a reward of no less than 2 million CNY will be given to each work.
For those plays who have won the "Mandarin Award", a reward of no less than 2 million CNY will be given to each of them.
For the works that won the "Stars Award", a reward of no less than 1 million yuan will be given to each.
Article 15 A movie industry support program shall be set up, with an annual allocation of up to 30 million CNY, to give subsidies for the creation and production of movie scripts, movie shooting services, R&D and production of movie technology and equipment, film exhibition activities, introduction and training of film talents, etc; awards will be given to top-quality movies, movie shooting and production, movie distribution and projection, international exchange and cooperation on movies, and movie investment.
Article 16 Guangzhou shall support the development of tourism in the whole region, encourage scenic spots and hotels to optimize their management services and upgrade their scale.
A park will be awarded 10 million CNY if it is rated as a national tourism demonstration zone, national tourist resort or other national park; each of them will be awarded a reward of 1 million yuan.
For newly rated as 5A and 4A tourist attractions, each of them will be awarded 10 million CNY or 1 million CNY respectively; The newly rated five-star or four-star tourist hotels will be awarded 3 million CNY or 1 million CNY respectively.
Each municipal village featuring cultural and tourism characteristics will be awarded up to 2 million CNY.
Guangzhou shall support graded tourist B&Bs, and give subsidies of up to 200,000 CNY to each of the star-rated B&B above the municipal level.
Article 17Guangzhou cultural and tourist characteristic brand promotion program will be implemented, with an annual allocation of up to 10 million CNY to support up to 10 Guangzhou intangible cultural heritage, urban cultural exhibition, new public cultural space, cultural and tourist image promoting and characteristic promotion brand programs.
Chapter 3 Application for and Administration of Special Funds
Article 18 The funds involved in these Measures shall be borne by the municipal public finance. If the same organization and similar items meet the conditions for multiple support programs specified herein, or meet similar support conditions stipulated in other policy documents of Guangzhou, they shall "be given the highest support giving up other supports". Only one application for support for a single project can be submitted within a single application year. The tax related expenses for support shall be borne by the organization receiving the support.
Article 19 The work on applying for funds shall be organized once a year, and the application submission time shall be subject to the notice from the municipal bureau of culture, radio, television and tourism. According to the annual work requirements, the municipal bureau of culture, radio, television and tourism shall put forward the annual support focus, support conditions, support standards, fund management mode and relevant requirements for funds, and shall publish the project application guideline through the relevant information platform.
Article 20An organization applying for funds shall apply for a project as required and be responsible for the legality and authenticity of the project applied for and relevant materials. Conditions and requirements for application are as follows:
(1) The applicant organization shall be an enterprise, public institution or other organization engaged in the research, development, production, service and management of the culture and tourism industry in this city.
(2) The applicant organization shall have perfect corporate governance structure, sound financial system and good credit.
(3) The added value, business income, amount of paid tax, and business index data submitted by the applicant organization shall be objective and true.
(4) In the past two years, the applicant organization has not been involved in any major or more severe workplace accidents, major or more severe environmental pollution accidents or other major or more severe illegal acts.
Article 21Application materials:
(1) Application documents for special fund, including application form for special funds, etc.
(2) Social unified credit code certificate and other materials relating to the enterprise' or the organization's qualification.
(3) The organization's financial and accounting statements of the previous year audited by a certified public accounting firm, as well as auditor reports.
(4) A written commitment to the authenticity of the project involved in the application and to the standardized use of the special funds in accordance with the law.
Chapter 4 Review and Appropriation of Funds
Article 22Special fund support review procedures:
(1) Preliminary examination. The culture, tourism (or sports) bureau of each district shall, together with other relevant authorities, conduct the preliminary examination and summary of the projects proposed to be supported in this district, and then report to the municipal bureau of culture, radio, television and tourism.
(2) Project evaluation. The municipal bureau of culture, radio, television and tourism shall organize experts or entrust a third party organization to evaluate the comprehensive situation of the project involved in the application.
(3) Expert review. The municipal bureau of culture, radio, television and tourism shall entrust a third party organization to jointly review the project and put forward suggestions on the use of special funds. After the collective deliberation by the joint review expert group, the amount of project support can be adjusted depending on the total amount of funds of the year and the progress of project application in the current year.
(4) Approval by the competent authority. The project to be supported as determined by the joint review shall be examined and approved by the municipal bureau of culture, radio, television and tourism according to the procedures.
Article 23 Project announcement and funds allocation:
(1) For the projects to be supported, the municipal bureau of culture, radio, television and tourism will announce them on its official website for 5 working days.
(2) According to the results of announcement, the municipal bureau of culture, radio, television and tourism formulates the annual plan for project support funds.
(3) The municipal finance bureau shall issue the project budget indicators in accordance with the relevant provisions of the annual plan for project support funds.
Chapter 5 Use of Special Funds
Article 24Each organization using funds shall strictly implement the financial rules and regulations, with all expenditures being used exclusively according to the funds use plan, and consciously accept the supervision and inspection on the use of special funds by the competent finance and audit authorities.
Chapter 6 Administration and Supervision
Article 25 The municipal bureau of culture, radio, television and tourism shall carry out daily supervision and inspection on the implementation of the special funds budget, and identify and correct the existing problems in time. The municipal finance and audit bureaus shall supervise and inspect the special funds. The relevant supervision and inspection shall be carried out in a way that adheres to the law and does not interfere with the normal operation of the organizations using funds.
Article 26The administration of special funds shall implement the accountability mechanism. In case of any violation of law or discipline in the process of application for, administration and use of special funds, the applicant organization shall deal with the violation and recover the special funds in accordance with the Regulations on Punishment for Financial Violations and other relevant provisions. Those responsible for such violation of law or discipline shall be punished in accordance with the relevant provisions. Those suspected of committing crimes shall be handled by competent judicial organs.
Chapter 7 Information Disclosure
Article 27 According to the regulations, the municipal bureau of culture, radio, television and tourism shall publish the following information on the unified platform for special funds management of the municipal government's online service center and the official website of the municipal bureau of culture, radio, television and tourism:
(1) Special fund management measures;
(2) Guidelines for applying for special funds;
(3) Details of application for special funds, including applicant organizations, projects involved in applications, etc;
(4) The allocation of and law enforcement against special funds, including the details of allocation items, allocated amount, allocation recipients, etc.
If State secrets are involved, they shall be subject to the relevant confidentiality requirements.
Chapter 8 Performance Evaluation
Article 28 The Municipal bureau of culture, radio, television and tourism shall entrust a third party organization to conduct fund performance self-evaluation according to relevant regulations, and cooperate with the municipal bureau of finance in performance evaluation. The municipal finance bureau is responsible for the performance evaluation of the overall use of the special funds in the previous year.
Chapter 9 Supplementary Provisions
Article 29These Measures shall become effective as of the date of promulgation and shall be valid for 5 years. If any documents serving as the basis for these Measures are revised and adjusted, the provisions after such a revision shall be followed.
